News staffer Dennis Georgatos, any appeal would involve evidence from both sides presented before a special master who would then render a decision. A date hasnt been set for a grievance hearing, but a league source said it almost certainly would be held within a week.
At issue is the deadline for notifying the 49ers in writing of Owens intention to void his contract. Joseph was quoted in previous news reports as saying he could execute the clause by informing the 49ers by March 2, the day before the new league year.
However, the 49ers contend that an amendment to the collective bargaining agreement moved up that deadline to Feb. 21. They say that even though Owens paperwork was sent in, it was too late, a claim that the league is backing, NFL spokesman Michael Signora said.
The surprising turn of events occurred after both sides behaved as if a parting of ways was inevitable.
Despite Owens standing as one of the NFLs most dynamic receivers, the 49ers hadnt initiated any conversations with him or his agent about working a new deal. Owens, in a handful of interviews, said he relished the thought of playing elsewhere after eight stormy seasons with the 49ers.

Instead, the 49ers and Owens remain united pending the outcome of the anticipated grievance hearing. Now what?
There appears to be three options for the 49ers -- cut Owens, trade him or keep him.
According to Georgatos, management and coaches privately concede theyre fed up with Owens.
